The Pennsylvania Fish and Boat Commission wants Consol Energy Inc. to pay damages to the state for a 2009 fish kill in a creek that straddles the state line with West Virginia.
The loss of the aquatic life cut the number of fishing trips along Dunkard Creek by about 1,500 visits and will cut another 15,300 during the next seven years, the commission says in a lawsuit filed on Wednesday in Greene County Common Pleas Court.
